Make Up For Ever LGBTQIA+ Education & Artistry Scholarship Fund Application Terms



The Make Up For Ever Scholarship (“Program”), offered by Make Up For Ever, LLC (“MUFE”), is intended to provide educational opportunities to individuals who identify as part of the LGBTQIA+ community who need it most, as makeup artistry is often a vehicle for LGBTQIA+ individuals to discover and embrace their identities. The goal of the Program is to relieve the increased hardship and economic disadvantage the LGBTQIA+ community faces when seeking education opportunities, by providing financial assistance for tuition to attend a post-secondary makeup artistry educational program.

ELIGIBILITY

Program is open to legal residents of the United States and Canada, 18 or older, who identify as LGBTQIA+, who were/are/will be full-time students in a post-secondary makeup artistry educational program in 2022, 2023 and/or 2024. Individuals cannot have a household income for 2022 that exceeds $50,000. Employees of MUFE, its parent, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible. Void where prohibited by law. Program is subject to all applicable federal, state, provincial, territorial and local laws. By participating, each applicant agrees to abide by these Application Terms and decisions of MUFE, which shall be final and binding in all respects relating to all Programs.

APPLICATION SUBMISSION

Applications will be accepted between 12:00am EST on June 1st, 2023 and 11:59pm EST on December 31st, 2023 (“Application Period”). To submit an application, visit the application link and follow the directions provided, including a video of 60-90 seconds in French and/or English which expresses what makeup artistry means to you, how makeup has served as a tool to discover your LGBTQIA+ identity, and any economic hardship, disadvantage, inequality of opportunity or discrimination you have experienced as a result of your identity. Video shall include no individuals other than yourself. All applications must be received during the Application Period. Limit one (1) application per person. Applications received from any person in excess of the stated limitation will be void. Applications generated by script, macro or other automated means or by any means which subvert the application process are void. All applications become the property of MUFE and will not be acknowledged or returned.

REQUIREMENTS OF APPLICATIONS

Application must be applicant’s own work product, may not have been previously published, and may not have won previous awards. Application may not contain, as determined by MUFE, in its sole discretion, any content that:
- is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
- promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
- is obscene or offensive; endorses any form of hate or hate group;
- appears to duplicate any other submitted applications;
- defames, misrepresents or contains disparaging remarks about other people or companies;
- communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
- violates any law.

MUFE, in its sole discretion, may disqualify your application for any reason, including if it determines that your application fails to conform to these Application Terms in any way or otherwise contains unacceptable or inappropriate content.

SCHOLARSHIP RECIPIENT DETERMINATION

All eligible applications received for a Program will be reviewed based on the following equally-weighted criteria: eligibility, need, diversity, reasons for how make-up has helped them discover their identities and any economic hardship, disadvantage, inequality of opportunity or discrimination experienced in connection with identity. MUFE reserves the right to not award all Scholarship Awards for if, in its sole discretion, it does not receive any eligible and qualified applications. All decisions of MUFE are final and binding. MUFE will not provide feedback on any application.

SCHOLARSHIP RECIPIENTS NOTIFICATION

The potential Scholarship Recipients will be notified by email and will be required to respond to initial notification within 72 hours. Potential Scholarship Recipients may be required to execute and return a Declaration of Eligibility, Liability and, unless prohibited, Publicity Release as well as their tax return from 2022 (or similar, if not available) (collectively the “Release”). Potential Scholarship Recipient’s parent or legal guardian will be required to ratify the Release of any Potential Scholarship Recipient who is below the age of majority in their applicable jurisdiction of resident. If a potential Scholarship Recipients does not respond to the initial notification within the time period stated, does not return all required documentation within the time period stated, or if any notification is returned as undeliverable, or a potential Scholarship Recipients is not in compliance with these Application Terms, Scholarship Award will be forfeited.

SCHOLARSHIP AWARD

Five (5) Scholarship Awards will be available as follows:
Exact amount of Scholarship Award will be dependent on the cost of the program in which the Scholarship Recipient enrolls/enrolled but will not exceed $10,000 USD. Scholarship Awards will be paid by MUFE directly to the school designated by the Scholarship Recipients, to help defray the Scholarship Recipient’s costs of education at such school (the “Scholarship”). The program enrolled in by the Scholarship Recipient must be a program within the beauty industry and be located within the U.S. or Canada. The Scholarship Award will be held in escrow by MUFE until the Scholarship Recipients notify MUFE in writing of the school that he/she is attending and provides proof of acceptance and enrollment in such school as of the time that such notification is provided. If MUFE does not receive such notification by the end of January 2024, the Scholarship Recipient will forfeit all rights to the Scholarship Award.

All federal, state, provincial, territorial and local taxes, if any, and all other costs and expenses associated with Scholarship Award acceptance and use not specified herein as being provided are the sole responsibility of the Scholarship Recipients. Scholarship Recipients(s) may not substitute, assign or transfer Scholarship Award. Scholarship Award is not redeemable by Scholarship Recipients for cash. All Scholarship Award details are at MUFE’s sole discretion. Limit one (1) Scholarship Award per person.

PUBLICITY GRANT AND LICENSE/USE OF APPLICATIONS

By submitting an application, each applicant waives all moral rights in and to the application and grants to MUFE and its licensees, successors, designees, and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the application and all elements of such application, together with any other material, and the name, city and state/province/territory of residence, voice, image and/or likeness of applicant, in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, applicant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade. Applicant agrees that, if required by MUFE, he/she will sign documents to this effect. MUFE has no obligation to make use of the rights granted herein.

GENERAL CONDITIONS

By participating, each applicant agrees to release, discharge and hold harmless MUFE, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from applicant’s participation in a Program or any Program-related activity or the acceptance, possession, use or misuse of any Scholarship Award.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled applications, emails, messages or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with a Program, including, without limitation, errors or difficulties which may occur in connection with the administration of a Program, the processing or review of applications, the announcement of the Scholarship Award recipients or Scholarship Awards, or in any Program-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to any person's computer or other device related to or resulting from participating in this Program. Persons who tamper with or abuse any aspect of a Program or any website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Application Terms, as solely determined by MUFE, will be disqualified and all associated applications will be void. Should any portion of a Program be, in MUFE’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of MUFE, corrupt or impair the administration, security, fairness or proper play, or submission of Applications, MUFE reserves the right at its sole discretion to suspend, modify or terminate the Program. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF A PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MUFE RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

APPLICABLE LAWS AND JURISDICTION

These Programs are subject to all applicable federal, state, provincial, territorial and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Application Terms shall be governed by the laws of the State of New York.
